OPSS & UK Cosmetics Compliance

OPSS: The UK Authority for Cosmetic Product Safety and Compliance

In the United Kingdom, the safety and compliance of cosmetic products are regulated by the Office for Product Safety and Standards (OPSS). As the national authority responsible for product safety, OPSS plays a pivotal role in ensuring that cosmetic products placed on the UK market meet rigorous standards designed to protect consumers and uphold industry integrity.

Established in 2018, OPSS operates under the Department for Business and Trade (DBT). Its remit covers a wide range of consumer products, including cosmetics. Following the UK’s departure from the European Union, OPSS assumed full responsibility for enforcing the UK Cosmetics Regulation, which is based on the retained version of the EU Regulation (EC) No. 1223/2009.

This regulation applies to cosmetic products sold in Great Britain (England, Scotland, and Wales), while Northern Ireland continues to follow EU cosmetic rules under the Northern Ireland Protocol.

OPSS and Cosmetic Regulation

OPSS ensures that cosmetic products placed on the market are safe, properly labeled, and fully traceable. Its scope of responsibility includes:

  • Market surveillance: Monitoring cosmetic products to detect non-compliance, safety risks, and potential consumer harm.
  • Enforcement: Taking corrective actions—such as product recalls, fines, or legal proceedings—when violations occur.
  • Business guidance: Providing comprehensive resources to help manufacturers, importers, and distributors meet regulatory obligations.
  • Ingredient oversight: Reviewing and updating lists of restricted or banned substances based on scientific evidence and global best practices.

A key requirement enforced by OPSS is the appointment of a UK-based Responsible Person (RP) for each cosmetic product. The RP is legally accountable for ensuring that the product complies with all applicable regulations before it enters the UK market.

Conclusion

OPSS serves as a cornerstone of the UK’s product safety framework, particularly for the cosmetics sector. For businesses operating in or entering the UK market, understanding and complying with OPSS regulations is not just a legal obligation—it is a strategic necessity. As regulatory expectations continue to evolve, proactive engagement with OPSS guidance helps ensure compliance, streamline market entry, and build consumer trust in an increasingly competitive landscape.
